2. Services Provided

Matterhorn Labs provides a subscription-based economic calendar service, including but not limited to:

• Real-time economic event tracking.
• Customizable user calendars.
• Community features (comments and forums).
• AI-powered search and analysis tools.

3. Eligibility and Registration

• Account Creation: You must provide accurate and complete information when creating an account.
• Security: You are responsible for maintaining the confidentiality of your login credentials.

4. Subscriptions and Payments

• Billing: Access to premium features is subject to a recurring subscription fee. All prices are in CHF and include VAT where applicable under Swiss law.
• Renewals: Subscriptions automatically renew unless cancelled before the end of the current period.
• Refunds: Under Swiss law, there is no statutory right of withdrawal for digital content once performance has begun. Refunds are granted at the sole discretion of Matterhorn Labs.

5. Intellectual Property and AI Usage

• Ownership: All content, including the economic data structures, AI algorithms, and branding, is the property of Matterhorn Labs or its licensors.
• AI Tools: Our AI tools are provided for informational purposes. While the AI analyzes economic events and user-generated content, Matterhorn Labs does not guarantee the accuracy, completeness, or reliability of AI-generated insights.
• User License: By posting comments or forum messages, you grant Matterhorn Labs a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content, including for training or refining our AI models.

6. Acceptable Use and Community Standards

Users agree not to:

• Post spam, defamatory content, or financial “shilling”.
• Use automated bots to scrape economic data without written permission.
• Reverse-engineer the AI or mobile application.
• Provide regulated financial advice without proper licensure.
• Post “insider info”, defamatory comments, or “pump and dump” schemes.

7. Disclaimers : Not Financial Advice

The Platform provides information only. We do not provide investment, trading, legal, or tax advice. All economic data is for educational and informational purposes. Matterhorn Labs is not responsible for any financial losses incurred based on the information provided on the Platform. Users are solely responsible for their own investment and trading decisions and the publication of data on the Platform does not constitute an "offer" or "solicitation" to buy or sell any financial instrument. The content on the Platform does not constitute financial, investment, or trading advice. The Platform is not a registered investment advisor. Any trades placed based on the data provided are at your own risk. In no event shall Matterhorn Labs be liable for any trading losses, lost profits, or any indirect, incidental, or consequential damages resulting from the use of data on the Platform.

8. Limitation of Liability

To the maximum extent permitted by Swiss law (Art. 100 CO), Matterhorn Labs shall not be liable for:

• Inaccuracies in economic data or event timing.
• Service interruptions or technical failures.
• Actions or content posted by other users in forums or comments.

9. Beta Version Disclaimer and Service Availability

• "As-Is" Status: The Platform is currently in its "Beta" development phase. You acknowledge that the Platform, including the AI search capabilities and mobile application, may contain bugs, errors, or inaccuracies and may not function as intended. The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind.
• Downtime and Maintenance:  Matterhorn Labs does not guarantee 100% uptime. Access to the Platform may be suspended, restricted, or terminated at any time to allow for repairs, maintenance, or the introduction of new facilities or services, particularly during this Beta phase.
• Data Loss: We are not liable for any loss of data, including custom calendars or forum contributions, resulting from technical issues, system updates, or the transition from Beta to a stable release. Users are encouraged to maintain their own backups of critical information.
• No Guarantee of Accuracy: During the Beta period, economic event data and AI-generated summaries may experience delays or synchronization issues. Matterhorn Labs shall not be held liable for any financial or personal decisions made based on interrupted or delayed data.
• Indemnification: You agree to hold Matterhorn Labs, its employees, and its affiliates harmless from any claims, losses, or damages (including legal fees) arising out of technical malfunctions, service interruptions, or your reliance on the Beta version of the Platform.

10. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy. In compliance with the Swiss Federal Act on Data Protection (FADP) and, where applicable, the GDPR, we process your data to provide the service and improve our AI capabilities.

11. Termination

We reserve the right to suspend or terminate your account immediately, without notice, for conduct that we believe violates these Terms or is harmful to other users or the Platform’s integrity.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Switzerland. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Zug, Switzerland.
